Terms of Service

You must be at least [13 — or your chosen minimum age] years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

Some features require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Tell us promptly if you suspect unauthorized use. You may delete your account at any time from [in-app path to delete account, e.g. Settings → Account → Delete Account], and we will delete or de-identify your associated data as described in our Privacy Policy, except where we are required to retain it.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Better Golf App for your own non-commercial golf improvement. We reserve all rights not expressly granted to you.

You may not, and may not allow others to: copy, modify, reverse engineer, decompile, or create derivative works from the Service; sell, rent, sublicense, or commercially exploit it; circumvent any access or security controls; or use the Service in any way that violates these Terms or applicable law.

The Service may offer paid features, subscriptions, or one-time purchases. Purchases made through the Apple App Store are processed and billed by Apple under Apple's terms, not by us. Prices, billing cycles, and what each plan includes are shown at the point of purchase.

The Service uses artificial intelligence to analyze the golf data you log and to generate insights, identify likely weaknesses, and recommend practice drills and course-management ideas. These outputs are generated automatically and are provided for general improvement and informational purposes only.

Some AI features rely on a third-party AI provider, and the data needed to generate a response is processed by that provider as described in our Privacy Policy.

You retain ownership of the rounds, stats, notes, and other content you create or submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to operate, provide, secure, and improve the Service, including generating your AI insights and drill recommendations.

You are responsible for Your Content and represent that you have the rights to submit it and that it does not violate any law or third-party right.

When using the Service, you agree not to:

• •Break the law or infringe anyone's rights, including intellectual property or privacy rights;
• •Upload viruses, malicious code, or content that is unlawful, harassing, or harmful;
• •Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• •Scrape, harvest, or use automated means to access the Service without our permission;
• •Interfere with, overload, or disrupt the Service or the servers and networks behind it.

The Service, including the Better Golf name and logo, the app software, the drill library, AI coaching personalities, text, graphics, and design, is owned by Better Golf Group, LLC or its licensors and is protected by intellectual property laws. Except for the limited license above, nothing in these Terms transfers any of our rights to you. You may not use our trademarks without our prior written permission.

The Service may link to or rely on third-party products and services, such as the Apple App Store, our email provider (Flodesk), and our AI and infrastructure providers. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any insights, recommendations, or results will be accurate or meet your expectations.

To the fullest extent permitted by law, Better Golf Group, LLC and its members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of [the amount you paid us in the 12 months before the claim] or [USD $100]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Better Golf Group, LLC and its members, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute resolution — will survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the dispute resolution terms below, you agree that any dispute will be resolved in the state or federal courts located in [Orange County], California, and you consent to their jurisdiction.

If you download the app from the Apple App Store, the following also apply:

• •These Terms are between you and Better Golf Group, LLC only, and not with Apple. Apple is not responsible for the app or its content.
• •Your license to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• •Better Golf, not Apple, is solely responsible for the app, its content, maintenance, support, and any product warranties, and for addressing any claims relating to the app (including product liability, legal or regulatory compliance, and intellectual property claims).
• •Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
